By using our Site, you agree to accept these Terms. If you do not agree with these Terms, you should cease using this Site. Your purchase and use of a Product is also subject to any additional terms and conditions which apply specifically to that Product. These Terms contain the entire agreement between us and supersede any other oral or written communication or agreement you may have with us. We may change these Terms at any time without notice. Any such changes will apply on and from the time they are published on our Site, but will not affect any Orders lodged prior to the time of publication of the Terms. You should check these Terms before placing any Order and contact us if you have any questions.
  • ORDERING
    You must: · Only order Products in accordance with the instructions on this Site; and · pay for the Products in full by authorising us to charge your Credit Card Account. You warrant that you are authorised by the relevant credit card company to use the Credit Card Account that you enter details of onto our Site in connection with your Order. While we will endeavour to fulfil your Order, we will not be liable to any person if we decline to fulfil an order, or we are unable to supply the Products in your Order. No contract for sale and purchase of Products will be formed, or variation or cancellation made, until we confirm acceptance of your Order, variation, or cancellation. After you have placed your Order and we have processed your payment, you will receive an automated email from our Site confirming your Order has been received. This email is not a guarantee that the Product(s) you have ordered is/are available. By placing an Order via our Site you are issuing us with an offer to purchase. We accept that offer when we fill your order and are ready to dispatch your Product(s). We confirm that by sending an email to you when your Product(s) have been dispatched. That email constitutes our acceptance of your offer and the formation of a contract between us. Some Products may be unavailable from time to time. We reserve the right to alter, or discontinue any Product or information contained on the Site without notice. We may cancel orders if we believe that they are fraudulent, or if an error has occurred including, without limitation, listing on the Site with an incorrect price or information. For transactions shipped within Australia and all other territories, your credit card will be charged by “HOUSE OF ALCHEMY AUSTRALIA”.
  • PRICE & PAYMENT
    All prices for products are in Australian dollars and, where applicable, include GST. All prices are correct at time of publication on our Site; however, we reserve the right to alter prices as required at any time without notice. The price(s) for Product(s) ordered by you shall be as shown in your shopping cart at the time of you completing your Order. We will not be liable for any damages or losses (direct or indirect) caused if your card is used fraudulently by someone else, except to the extent that such loss or damage is caused by our negligence or wilful misconduct. We may at our discretion conduct fraud detection processes to check the legitimacy of any order and payment method and our bank may do the same, without notice. Security Policy When purchasing from our Site, card details are transmitted through a secure server. Payment for Products displayed on www.houseofalchemy.com will be made using a secure online Visa or MasterCard transaction facility. We use industry standard encryption in the payment process to keep your personal information secure. Card data is not hosted by House of Alchemy Australia after processing. Special offers From time to time we may at our discretion offer specials on our Site. If so, the price for any Product(s) you order shall be as displayed on the Site, including any discount published on the Site at the time you place your Order. We give no guarantee that any Product(s) will be subject to a special offer at any time. We may at any time at our discretion offer delivery promotions or offers. If we do decide to do so, such a promotion or offer may only be available on certain Product(s) and/or to certain locations. You should check the terms of any such promotion. We make no guarantee that we will offer any such promotions or offers at any time.
  • DELIVERY
    Shipping within Australia House of Alchemy Australia - ships goods Australia-wide. Please note that at this time we are unable to ship to New Zealand. If you have a special order request contact us for further enquires. For UK or international orders please make sure to visit: www.houseofalchemy.co.uk Method of Delivery We deliver our products using Australia Post. Shipping costs are influenced by the size, weight and type of the Product(s) in your Order and your location, as well as current Australia Post pricing. Exact shipping costs are calculated in the shopping cart and will be added to the Order total before checkout. Orders are dispatched within 3-4 business days. Shipping times are estimated at between 5 and 7 business days depending on your location. Note: Some rural deliveries may take longer. Express Postage is also available and may be selected at checkout for an additional price as specified at checkout. Delivery is otherwise charged at a flat rate for orders within Australia. If you want to make any changes to an Order after the order has been lodged, this may incur additional Product and/or delivery charges (depending on the change). Contact us to find out more. We will deliver the Products to the premises nominated in your Order at your cost (at the shipping rate specified in your Order). If we have specified a delivery date in your Order, we will try and deliver the Products to you by that date. Time will not be of the essence and we will not be liable to you for late delivery. Late delivery does not entitle you to cancel any Order or part of any Order. We may deliver the Products to you by instalments and each delivery will be a separate contract independent from the other deliveries. Delivery estimates given in your Order are based on delivery to a ground floor front door, with easy access. If this is not the case, you should let us know at the time of placing your Order. If delivery of an Order would result, in our reasonable opinion determined at any time prior to dispatch, in unacceptably high freight charges to us, we reserve the right to contact you after the Order is placed to either request additional delivery fees from you or to cancel your Order prior to dispatch. If we cancel prior to dispatch, we will issue a full refund to you of the price paid for the Order. You may stipulate in your Order that you give our delivery agent authority to leave the Product(s) delivered in respect of your Order in a safe place as designated by you (Authority to Leave). If you do so, our delivery agent will leave the Order in the designated place if no one is otherwise home to receive them (after knocking or ringing the doorbell and waiting a reasonable time). You should check your information entered on our Site is correct before placing your order, and pay particular attention to the details of your delivery address. We take no responsibility for failure to deliver if your Product is returned due to an incorrect or insufficient address that you provided to us and you will be liable for all additional shipping charges in order for your delivery to reach you. If our delivery provider has been unable to deliver your order due to your error or fault after 21 days or 2 delivery attempts (whichever is the sooner), we reserve the right to cancel your Order. If we do so, we will refund you the money you have paid for your Order, less the delivery fees and reasonable handling fees as reflecting our loss. Title and Risk We shall not dispatch any Products you Order until you have paid in full all amounts that are owed for the Products. You will do this on our Site at the time of placing the Order. Risk in and title to the Products passes to you at the date and time of delivery to your address as specified in the Order or the Authority to Leave place specified by you in your Order. Shades of colour may also vary when shown on different displays and screens. Damaged Items We make every effort to ensure that your order arrives intact. It is normal for the shipping carton to show some wear from its journey to you. However if damage has occurred to the product(s) inside, please contact us here and we will be more than willing to resolve any issues. Consumer Guarantees and Limitation of Liability Our Products come with consumer guarantees that cannot be excluded under the Australian Consumer Law. However, House of Alchemy Australia’s liability is otherwise excluded or limited under these Terms, to the full extent permitted by law. On this basis, we exclude any implied terms, guarantees and warranties, and liability for expenses or injuries relating to these Terms, as well as circumstances outside our control and any loss, theft or damage to the Products after delivery to the address nominated in your Order. To the full extent permitted by law, we limit our liability to you to the amount paid by you for the Product(s) in your Order.
